 1. Heard Ms. Kadu for the petitioner. Ms. Pai
 appears for the State.

 2. The petitioner wants to be released on
 furlough. He had offered the surety of his own
 uncle by name Namdeo Bapu Bhanusdhare. It is
 stated that the uncle of the petitioner is running
 his own truck business and is permanently residing
 at flat No. 5326, S.R.P. Jagtap Chowk, Vikas
 Nagar, Wanori, Pune-6. The officer concerned from

 the jail has rejected the surety on the ground that
 it does not appear to be a proper and competent

 one. We do not see any reason as to why this
 person should be found not proper or competent.
 Accordingly, we allow this petition and set aside

 the order passed on 18.6.2004 and direct the
 respondent to accept the surety of Namdeo Bapu
 Bhanusdhare and release the petitioner on furlough.

 3. The writ petition is allowed in the above terms
 and disposed of accordingly.

 available to the parties.
