Appeal No.496 of 1999 is report	ed dead. The appeal in
so far as he is concerned, therefo	re abates.
2. During the	pendency of	the appeal No.570 of 1999,

accused	no.3	was released	on	bail	by		this	court.
Subsequ	ently that	accused no.3	was	not	pr	esent	in	court
or	was not	traceable.	Therefore	orders		were	issued	to
seek	his pr	oduction in court.	S	o far,		n	othing	has
been	done.	Police have	been	unable	to	app	rehend	the
accused	inspite	of orders of	this	court.		How	ever,	we
see no re post-pon	ason why the heari ed till he is produce	ng of the appeal should be d before the court.
3.	Heard	the learned co	unsel	for the		ap	pellants	in
both the	appeals and the lear	ned A.P.P. for the State.
3.	For	reasons recorded	separa	tely the		a	ppeals	are
allowed.	The convictions a	nd sentence passed by the
trial judg	e are set aside.

The accused who are on bail, their bail bonds are cancelled.

The accused who are in jail be released forthwith, if not otherwise required under the law.
