(AA), Prevention of Money Laundering Act (PMLA), 2002, in the matter of Original Application (O.A) 17/2014 filed by Directorate of Enforcement against these appellants. The appellants have, inter-alia, sought for quashing, setting aside and cancelling the impugned order dated 17.06.2016.

Brief facts of the case

2. It is revealed from the record that the Central Bureau of Investigation (C.B.I) registered 8 Regular Cases (R.C) against Sh. H.B. Chaturvedi, Chairman cum Managing Director, Amit Chaturvedi, joint managing Director, Sanjay Chaturvedi, Director, Sumit Chaturvedi, Director and Parvin Juneja, Director (Corporate Finance) of M/s Shamken Spinners Ltd., M/s Shamken Multifab Ltd., M/s Dwarkadish Spinners Ltd. and M/s Shamken Cotsyn Ltd. amongst others.

It is also revealed from the record that based on these 8 R.Cs, the Enforcement Directorate (ED) registered 8 ECIRs on different dates in the year 2009 being u/s 120-B of IPC,1860 and section 8 of Prevention of Corruption Act,1988 are scheduled offences under the PMLA,2002 in the Delhi Zonal office of Directorate of Enforcement, New Delhi against the aforesaid suspects/accused persons for the commission of offence u/s 3 of the PMLA and accordingly cases were taken up for further investigation under PMLA, 2002.

4. It is also seen from the record that initially the present appellants preferred appeals against order dated 16.10.2014 passed by the learned Adjudicating Authority (hereinafter referred to as “AA” ) in O.A No. 17/2014

under section 17(4) of PMLA, 2002. This tribunal vide its order dated 01.01.2016 set aside the order dated 16.10.2014 and remanded the matter to the AA for re-adjudication with certain directions.

5. The Ld. AA, in compliance with the said order of the Appellate Tribunal, re-adjudicated the O.A and re-confirmed the same on 17.06.2016. It is this order which is under challenge in the present appeals.

It is also revealed from record that during the pendency of these appeals the Enforcement Directorate issued Provisional Attachment Order (PAO) no. 07/2016 dated 15.09.2016 issued u/s 5(1) PMLA, 2002. In the said PAO the seized valuables i.e. Indian currencies, jewelleries and vehicles were also provisionally attached.

Subsequent to the passing of the PAO no. 07/2016 dated 15.09.2016, the Enforcement Directorate filed Original Complaint (O.C) no 642/2016 u/s 8(1) of PMLA, 2002 for confirmation of the said PAO which was confirmed u/s 8(3) of PMLA, 2002 by the Ld. AA on dated 03.02.2017. All the appellants herein have also challenged the order of confirmation of O.C dated 03.02.2017 vide Appeal nos. During the pendency of the present appeals, the appellants namely Amit Chaturvedi, Sanjay Chaturvedi and Sumit Chaturvedi filed an application for their substitution in place of the appellant late Sh. H.B. Chaturvedi, appellant in appeal no. FPA-PMLA-1417/DLI/2016 who expired on 15.12.2022. The said application was filed on 07.02.2023. copy of the said application was duly served on the Ld. counsel of the respondent ED. No reply has been filed. The said application was heard

and considered. The legal heirs are already on record through their respective separate appeals. Keeping in view the contentions made in the application and in the interest of justice, the said application bearing no. MP-PMLA-10931/DLI/2023 in appeal no. PMLA-1417/DLI/2017 is allowed and disposed of. The legal heirs are hereby substituted in place of deceased appellant late Sh. H.B. Chaturvedi.

12. During the course of proceedings, the respondent has filed written submissions wherein at para no. vii has stated as below:

“The contents of the para are wrong, false and hence are denied. It is contended that the properties that have been seized in the search u/s 17 of PMLA were found to be related to crime or “Proceeds of Crime” in terms of Section 2(1)(u) of PMLA which reads as “proceeds of crime” means any property derived or obtained directly or indirectly, by any person as a result of criminal activity relating to a scheduled offence or the value of any such property”. Therefore, an application u/s 17(4) of the PMLA was filed and Ld. Adjudicating Authority had allowed retention of the same vide order dated 16.10.2014 and 17.06.2016 as the investigation was going on. During further investigation under the provisions of the PMLA, the role of the defendants was further established in the offence of the money laundering, therefore, movable/immovable properties were attached vide PAO No. 07/2016 along with the properties seized u/s 17(4) of PMLA during search. So presently it can be construed that the appeal has become infructuous.”

13. Heard the learned counsels for both sides. On perusal of the record, written submission of respondent ED and the contentions made by the Ld. counsel for both the parties it appears that the properties, the details of which are listed as per the list made in the table at para no. 2 above were seized during the course of surveys/searches at different premises/places. The Ld. Counsel for the ED submitted that out of the seized properties listed at para no. 2 above, some of them which are listed in table at para no. 3 are attached vide O.C No. 642/2016 and confirmed on 03.02.2017. It is also contended by the Ld. counsel for the respondent ED that the properties listed in table at para no. 4 are not attached in the said O.C. On the basis of the aforesaid submissions, it is contented by the Ld. counsel for the respondent ED that these O.As are liable to be dismissed as infructuous.

14. During the course of argument, it is also contented by the Ld. Counsel for the respondent that 8 Prosecution Complaints have also been filed against the appellant in which Panchnamas dated 23.06.2014 drawn during the Search/Survey proceedings were made as relied upon documents before the Ld. Special Judge under PMLA, 2002 and that the said documents and items seized during the searches may be called during the trial of said Prosecution Complaints. On the aforesaid grounds, it is prayed by the Ld. Counsel for the respondent to retain all the seized documents until the completion of the criminal trial pending before the Ld. Special Judge under PMLA, 2002.

15. To the above, it was orally contended by the Ld. counsel for the appellants that the appellants have no objection if the articles which are not attached are returned to the appellants.

Discussion and findings:

16. It is an admitted fact that during the pendency of present appeals, PAO no. 07/2016 dated 15.09.2016 issued u/s 5(1) of PMLA, 2002 has been passed by the Enforcement Directorate attaching some of the properties involved in the present appeals.

17. I have considered the submissions made by the parties. The questions of law raised in the appeals has not been gone into. The only question that has been considered in the present order is whether the present appeals can be continued in view of the PAO no. 07/2016 dated 15.09.2016 passed by Enforcement Directorate for attachment of the properties including articles, jewellery, movable and immovable properties as reflected in the above tables.

As per the argument advanced by the Ld. counsel for the respondent that the respondent ED has stated that they have already filed 8 Prosecution Complaints in which the Panchnamas prepared during the course of Survey/Searches on 23.06.2014 are part of relied upon documents and it is also contended that the said documents and items seized during the search may be called during the trial of the said Prosecution Complaints. It is seen from the record that some of the seized articles/documents/movable and immovable properties are part of the PAO and confirmed by the Ld. AA. This being the situation, these appeals can be disposed of with following directions:

i. The respondent ED is allowed to retain those properties/articles /items /Electronic device/documents/jewellery and other valuables which are part of the O.C bearing no. 642/2016

arising out of PAO no. 7/2016 and also relied on by the respondent ED in the Prosecution Complaints pending before the Ld. Special Judge under PMLA, 2002. However, the copies of the documents, clone copy of the data recovered from the electronic device i.e. Lenovo laptop hard-disk be supplied to the appellants, if already not supplied, within eight weeks, provided the appellants apply for the same.

ii. If any of the properties/ articles/ items/ electronic device /documents / jewellery and other valuables which are seized and allowed to be retained by the Ld. AA but neither attached nor relied upon in the Prosecution Complaints, the same be returned within eight weeks to the appellants.
