The present application has been filed by the appellant for directions/to mention as per the direction of Hon’ble High Court of Calcutta in W.P. No. 1267 of 2020. Alongwith the application the appellant has filed copy of the order dated 27.11.2020 wherein this Tribunal has been asked to expedite the hearing of the matter and come to a decision therein subject to the constraints of the present pandemic

situation. Considering the same the appeal is pre-poned to today i.e. 22.02.2021 by cancelling the date already fixed on 11.03.2021.
Upon hearing, issue notice. Shri Rajeev Awasthi, the learned counsel for the Respondent accepts the notice and submitted that he has got the soft copy of the writ petition and written submissions through email on yesterday evening only but the copy of the order passed by Hon’ble High Court has not yet been supplied to which the learned counsel for the appellant has agreed to supply the same during the course of the day. The learned counsel for the Respondent further submitted that he will take appropriate instructions from the Respondent in the matter and he sought time to file appropriate reply which is not objected. Let the Respondent file the reply, if any, by the next date with an advance copy to the other side. It is also submitted by him that the matter may be taken up through Physical Hearing which is not opposed.
Heard both sides. The COVID-19 pandemic situation is still prevailing in the country. This Tribunal is facing constraint of space for physical hearing and therefore, to prevent any COVID-19 infection, the matters are being taken up through Virtual Hearing. At present it is not possible to take up the appeals for physical hearing. Therefore, with the consent of the learned counsels for both the parties the appeal is posted to 29th April, 2021.
Accordingly, list the appeal on 29th April, 2021.
