Learned counsel for the appellant is present. Ms. Sanjana Rajput, proxy counsel for Shri Nitesh Rana, learned counsel for the respondent is also present. During the course of hearing,, the proxy counsel appearing for the respondent has drawn the attention of this Tribunal’s order dated 13.05.2019 wherein it was mentioned that “The learned counsel for the respondent states that he has received the copy of the application to withdraw the appeal. The main counsel is not available.”

In this regard, the learned counsel for the appellant submits that they have not filed any such application for withdrawal.
