No one is appearing for the appellant in spite of specific orders passed on 17.01.2020 and 04.02.2020. There is a huge delay in filing the application for restoration of the appeal. The application for condonation of delay in filing the restoration application is pending for consideration since 2018 and there is very little effort from the side of the appellant/applicant to take part in the hearing of the application. The aforesaid conduct of the appellant/applicant shows that he has no intention to prosecute or proceed with the restoration application as well as application for condonation of delay in filing the restoration application.
In view of the above, the restoration application is dismissed for non-prosecution.
Registry is directed to send the copy of the order to the appellant.
