The matter is fixed today for hearing through physical hearing. It is submitted by Mr. Aditya Mukherjee, ld. counsel for the appellant that Mr. Siddhart Aggarwal, arguing counsel for the appellant could not participate in the physical hearing today due to prevailing COVID-19 situation and seeking an adjournment on the aforesaid grounds. Sh. Rajeev Awasthi, ld. counsel for the respondent is present in the court today.
The ld. counsel for the appellant submits that the appeal may be taken up through video conferencing on any short date possible in view of the covid19 situation, which prayer is objected by ld. counsel for the respondent and submits that it is not possible to hear the matter through virtual hearing due to voluminous documents and records of the appeal and involvement of various banks and appeals filed by them against the same order so the matter may be heard through physical hearing only when the situation improves.

Heard both the sides. The adjournment prayer of the appellant is considered and allowed. The connected banks’ appeals are listed on 11.01.2021. However, this appeal would be taken up on 15.12.2020 physically if COVID-19 situation is improved, otherwise it would be taken up through virtual hearing. It is agreed that the hearing of the case would depend on the circumstances on the next date.
Therefore, with the consent of both the parties, list the appeal on 15th December, 2020.
