The present appeal has been filed against the order dated 03.12.2014. The main grievance of the appellant is that none of the property of the appellant has been attached, however in the confirmation order, while dealing with the case of other defendants, the Adjudicating Authority has also passed the observations, the details of which are mentioned in paragraph 80 of the impugned order, wherein it is observed that the appellant has committed the scheduled offences, generated proceeds of crime and laundered them. The learned counsel for the appellant states in common order passed with the other

defendants, the said observation is made against the appellant also and the said observation be deleted from the impugned order as far as the appellant is concerned.

The learned counsel for the respondent states that as far as the merit is concerned, the same is to be dealt by the Special Court where the matter is subjudice and the matter will be decided on merit. Without expressing any opinion about the merit of the case, at this stage, we feel that in the absence of any attachment against the appellant, the observation against the appellant may not be read.

The impugned order is modified against the appellant is concerned.

The appeal is disposed off with the consent of both the parties.
