No reply to the application for condonation of delay has been filed. The appeal has been filed by AXIS Bank Limited. No notice under Section 8(1) was issued to the appellant. Counsel for the respondent states that notice under Section 8(4) was already been issued to the lead bank i.e. Bank of India. Therefore, no notice was required. The appellant is claiming independent rights against the borrowers. For the reasons stated in the application the delay of 149 days in filing the appeal has been condoned subject to the cost of Rs. 10,000/- which shall be paid by the appellant to the learned counsel for the respondent. MP is disposed of.
