The appellants have filed the above mentioned appeals against the impugned order dated 20^th November, 2018. Issue notice. Shri Nitesh Rana, accepts the notice on behalf of the respondent and seeks time to file the reply. Let the same be filed within six weeks with an advance copy to the counsel for the appellant who may file the rejoinder four weeks thereafter.

The learned senior counsel for the appellant is pressing for the interim order. One of the arguments of the learned senior counsel is that the impugned order passed by the Adjudicating Authority is infact the breach of the order passed by the Delhi High Court on 19^th November,

In this context, the senior counsel has referred the grounds (dd) of

the appeal, the same is read as under:

“The learned Adjudicating Authority failed to comply with directions of Hon’ble Delhi High Court in case of Writ Petition No. 11775 of 2018 (order dated 15.11.2018) & Writ Petitions No. 12380/2018 and 12381/2018 (order dated 19/11/2018) served duly vide letter dated 19/11/2018 on the Learned Adjudicating Authority delivered on 20.11.2018. Such blatant disregard to the directions of Hon’ble High Court indicates that the Learned Adjudicating Authority was in haste to further the agenda of Respondent without application of mind.”

It is also submitted that the learned senior counsel for the appellant states that ED was the party in the said writ petitions filed by some of the appellants herein, thus awareness about the passing of the order on 19^th November, 2018 cannot be denied as ED was also duly represented by the counsel. It is also stated that when the Adjudicating Authority has passed the order, it was the duty of the ED by itself or through counsel to inform the Adjudicating Authority not to pass the final order until further directions of the High Court. It is contended on behalf of the appellant that factum of the order was informed to the Adjudicating Authority, who on 20^th November, 2018, without caring chosen to pass the impugned order. In view of the aforesaid fact, I am of the opinion that the Adjudicating Authority should have passed the impugned order but to await the further directions from the Hon’ble Delhi High Court, as it was the duty of both authorities to obey the order passed by the Hon’ble Bench of Delhi High Courts. They must give due respect to the order of higher courts.

The prayer sought by the appellant is opposed by Mr. Rana. The undertaking has been given on behalf of the appellant that they shall not dispose of the attached property directly or indirectly or to create third

party interest till the next date.

Under these circumstances, it is directed that the attachment shall continue. None of the appellant shall create any third-party interest and not to dispose of the attached property directly or indirectly. However, no

physical possession shall be taken by the ED.
