The Bank of India has also filed the appeal against the impugned order. There is a delay of 65 days in filing the appeal. The reply has been filed by the respondent. Heard both the parties. Since the valuable rights are involved. Thus, for the reason stated in the application, the prayer is allowed. The delay in filing the appeal is condoned, subject to the cost of Rs. 10,000/-. The costs shall be paid by the Bank of India to the learned counsel for the respondent by the next date.

In both the appeals, one final opportunity is granted to the respondent to file the reply within two weeks.
It is clarified that in case the prayer made in the appeals are allowed, the period from the date of registering the ECIR till the date of dispose of appeal, the same shall be excluded.
