It is also submitted that the learned senior counsel for the appellant states that ED was the party in the said writ petitions filed by some of the appellants herein, thus awareness about the passing of the order on 19th November, 2018 cannot be denied as ED was also duly represented by the counsel. It is also stated that when the Adjudicating Authority has passed the order, it was the duty of the ED by itself or through counsel to inform the Adjudicating Authority not to pass the final order until further directions of the High Court. It is contended on behalf of the appellant that factum of the order was informed to the Adjudicating Authority, who on 20th November, 2018, without caring chosen to pass the impugned order. In view of the aforesaid fact, I am of the opinion that the Adjudicating Authority should have passed the impugned order but to await the further directions from the Hon’ble Delhi High Court, as it was the duty of both authorities to obey the order passed by the Hon’ble Bench of Delhi High Courts. They must give due respect to the order of higher courts.
