When the matter was listed on 23rd July, 2018, it was clarified that the appellant that copy of the provisional attachment order and copy of the complaint has been filed. However, it appears that the relevant document i.e. mortgaged deeds and other title deed which were executed in favour of the bank by the borrowers in any of the matters have not been filed. The case of the appellant is that the attachment order with regard to the properties could not have been passed as the said properties are mortgaged with the bank. In the absence of the said documents it is difficult to pass the final order. The appellantsin both matters are to file his relevant documents.
The registry is directed to list these matters for directions on 14th January, 2019.
