The original application in appeal no. FPA-PMLA1314/Cochin/2016 was filed in time. Since it was the joint independent appeal, the direction was passed to file the independent appeal on behalf of M/s. Tycoon Empire International Ltd. In filing of the said appeal the delay is occurred. We have gone through the application for condonation of delay. We are of the view that M/s. Tycoon Empire International Ltd. should have file the appeal within reasonable time but there is a long delay in filing the independent appeal. The appellant has given the

reason in para 3 of the application. It is also pertinent to mention that the respondent has filed the reply to the appeal. Considering the overall facts, the application for condonation of delay is allowed in filing the appeal subject to the cost of Rs. 10,000/- which shall be paid by the learned counsel for the appellant to the department by the next date.

In the meanwhile, the appellant is granted four weeks time to file the rejoinder. Parties are allowed to file the written synopsis by the next date.
