Fresh application has been filed for stay of taking possession. The appeal is pending since 2012. The impugned order in the above said matter was passed on 27^th July, 2012. The acquittal order has also been passed on 14^th February, 2018. The learned counsel for the appellant states that no appeal has been filed till date. The offence alleged taken place during the check period 1995 to 1998. The FIR was filed on 6^th March, 2006. The final report was filed on 28^th February, 2007. The provision of 13(1)(e) of Prevention of Corruption Act was added on 1^st June, 2009. Despite of acquittal order has been issued by the respondent by way of publication on 21^st July, 2018.

In view of the facts mentioned above, I am prima facie view case

has been made out in favour of the appellant.

As the appeal is coming up on 4^th September, 2018; the operation
