“Building at No. 2051, MIG in III Phase, Sector-“B” Yelahanka New Town Extension, Bangalore Extent = 96 square meters (1033 sq. feet @ Rs. 1,400 per sq. ft)”.

The learned counsel for the appellant submits that without prejudice, in the meanwhile the appellant may allowed to remove the pharmaceutical product (some of them have been expiry date) and other articles. On the last date of hearing, the matter was adjourned at the request of the learned counsel for the respondent sought time to take instructions from the department. When the matter is taken up today the learned counsel for the respondent states that liberty may be granted to the appellant to make the representation for the respondent for remove all the pharmaceutical product and other article from the said shop till the appeal is finally decided and such permission maybe granted within three days by the Deputy Director, Bangalore and he would pass the order accordingly. The appellant is granted liberty to removing all the article as well as pharmaceutical products within two days from the date of de-ceiling shop. After removing the same, the shop shall be re-locked. Let the representation be made within three days.
