Impugned order in the above matter was passed on 17th November, 2017. As per the record the copy was delivered on 17th November, 2017. The appeal was filed on 5th January, 2018. Apparently there is delay of two or three days. No specific application has been filed for condonation of delay. However, in the circumstance that the delay is at best of 2 or 3 days, if any application had been filed by the appellant, we would have condoned the delay. In the interest of justice and fair play we are inclined to condone the delay in filing the appeal.
Issue notice in the appeal. Mr. Amit Sibal, Sr. Advocate accepts the notice on behalf of the respondent and seeks time to file the reply. Let the reply be filed within four weeks with an advance copy to the counsel for the appellant who may file the rejoinder within four weeks thereafter.
In the meantime, reply to the interim application may also be filed
within four weeks.
