The appellant is a professional, who has filed the present appeal against the order dated 29th September, 2017. Respondent in the above said matter carried out searches on 13th April, 2017 at various places including the office of the appellant and seized the documents on record, details of which are mentioned in the Panchnama.
Counsel for the respondent states that as far as the appellant is concerned, two hard disks were seized. The appellant was called for recording the statement and the same was recorded. However, the appellant had not been called again by the respondent. The case of the appellant is that no reason was stated by the respondent in the application filed under Section 17(4) of the Prevention of Money Laundering Act, 2002 as to why the records of the appellants are required to be retained. It is stated by him that no reason to believe have been served to the appellant.
The learned counsel for the respondent states that as far as the copies of hard disks are concerned, the respondent may give the copies if

the said hard disks are available with the respondent by the next date (if already not given to the appellant).
Copies of the reason to believe have not been given to the appellant. Counsel for the respondent states that the same are not lying with him and he will check up with the ED and if the same is lying with the ED, he will produce the same on the next date of hearing in a sealed cover.
Counsel for the respondent does not file the reason to believe before the search was conducted on 13th April, 2017 and he says that he will verify the same and in case the same is lying with the ED, he will produce the same by the next date in a sealed cover.
