It appears from the present case that the appellant had gone to the Bombay High Court against the Tribunal’s final order dated 13.12.2010 wherein their appeal was dismissed vide its order 16.03.2012. It remanded the matter back to the Tribunal to decide the case afresh after taking all material which has been relied upon by the appellant. However, since then no one has been appearing whenever the matter has been listed. I therefore feel that they are not interested in pursuing their appeal and the appeal is dismissed for non-prosecution.
