The Learned Counsel for the appellant has pointed out that a schedule offence allegedly as per admitted case of the respondent have been committed during the period 22nd June, 2008 to 21st July, 2008. The FIR is registered in 2008. The said schedule offences in question were added in the list of schedule offences on 1st June, 2009 therefore, he submits that the PMLA proceedings be quashed. The Learned Counsel appearing on behalf of the respondent on instruction submits that the similar view in favour of the appellant taken by the Hon’ble Karnataka High Court Division Bench in the case of Obulapuram Mining Company Ltd. The respondent has challenged the said judgment in the Hon’ble Supreme Court.
