In view of the last order, the learned counsel for the appellant informed that a communication dated 13/01/2017 was issued to the appellant is not interested to proceed further in the appeal. The contents of letter dated 28th February, 2017 are re-produced here below:-
“ We have received your letter no. AR/101/2017 dat. 13/1/2017 on 19/01/2017. However, we were consulting our local lawyers and experts on this issue.
You may be aware that on 12.01.2015, the three bench Appellate Tribunal(PMLA) gave their order that ‘the attachment of Adjudicating Authority is valid and there is no apparent illegality. The appeal is therefore dismissed.’
Thereon, Enforcement Directorate has registered a PMLA case in our name in 2015 in CBI Court, Kolkata which is pending.

Under the Circumstance, the considerate views are that there is no point going for an appeal against the Tribunal Order, more so because the same assets have been attached by CBI Also.”
In view of the said response of the appellant, the appeal is accordingly
