As per submission of the learned counsel for the respondent this matter has some bearing in another appeal no. FPA-PMLA310/MUM/2011 which is coming up for hearing on 21^st February, 2017. List this appeal on 21^st February, 2017.

In view of the earlier order the application is being disposed of with the consent of the parties. The fact of matter is that the appellant filed the appeal under section 26 of PML Act, 2002 against the impugned order dated 03.11.2011. This Tribunal on 25^th November, 2015 stayed the dispossession from the property till the next date. The said order is being continued from time to time. In the meanwhile during the pendency of the

appeal, the above mentioned application has been filed seeking some urgent order for repairing the said property. It is stated in the application that the appellant received a letter dated 20.12.2015 from one Mr. Ranjan Kapoor resident of Flat No. 1, 10A, Prithviraj Road, New Delhi i.e. the flat below the attached property complaining of seepage problem that they were facing due to water leakage from the property in question. It is alleged in the application that the leakage may be due to very old pipes and plumbing in the flat. In view thereof some directions are sought by the appellant stating that since no repairs were being undertaken, seepage has affected the whole walls and ceilings, the prayer be granted.

Mr. Rajeev Awasthi, learned counsel for the respondent submits that as far as prayer of this application is concerned, the respondent has no objection. However, the appellant would not be permitted to do any construction/renovation in the garb of this order in the property. He has no objection of the details which are mentioned in application be carried out. He submits that if the Tribunal so directs, the respondent will send an officer at the site in the presence of the appellant who would examine the same to ascertain if any repair is required after fixing the meeting within one week from today. The same be done in the presence of both the parties. The application is accordingly disposed of. Necessary steps be taken by both sides within one week from today.
