As far as stay application is concerned. Learned counsel for the appellant is pressing the interim order in view of the notice issued under Section 8(4) of the Act. Regarding other properties he is not pressing any relief. The detail of the said property is as under:

It is a 1080 Square feet old tiled house which was demolished and then constructed during the year 2010 by obtaining loan from some individual person. In his statement he admitted that this loan was repaid by him out of the amount of Rs. 82 lakhs received as commission from bank. Therefore a portion of this property is definitely from the proceeds of crime and is liable for confirmation for attachment under PMLA”.

Learned counsel for the respondent seeks time to verify the position and inform this Tribunal about the market value of the rent alongwith reply in the interim application so that if necessary the appropriate order be passed for fixing the market rent. Respondent has granted four weeks time to file the reply to the fresh interim application with an advance copy to learned counsel for the appellant who may file the rejoinder four weeks thereafter. List this application also for hearing alongwith the appeal on 31^st July, 2017. Subject to the same operation of the notice dated 8(4) of the Act shall remain stayed in reply of the above
