Alongwith the application, the eviction notice dated 2nd December, 2016 has also been filed whereby the respondent intends to take the possession of the property known as Building No. XIII/462 (New) (X/284 A-Old), Edapal Grama Panchayath, Edapal Village, Malappuram. The learned counsel for the appellant has referred to the earlier order dated 27th December, 2016 passed in FPA-1572/COCHIN/2016 in the case of Hassan A A where interim protection was allowed to another appellant involved in the same O.C. He further submits that the attached property is a residential house jointly owned by Shri Hameed Pandarathil, appellant in the present appeal no. FPA-PMLA/COCHIN/2017 and Smt. Sulaikha, (appellant in FPA-PMLA/1601/COCHIN/2017). It is submitted that the appellant and Smt. Sulaikha, (appellant in the Appeal No. FPAPMLA/1601/COCHIN/2017), who are husband and wife are residing in the attached property alongwith their children. He undertakes that both the appellants shall not create any third party right in the said property or sell, alienate the same in any manner till the disposal of the appeal directly or indirectly. He further submits that he would submit the valuation of the market rent of the subject property by the next date. The appellant will file the affidavit along with the valuation report before the next date of hearing. The learned counsel for the respondent on the other hand submits that the market rent of the said property is around
