This is an application filed by the appellant for condoning the delay of 50 days in filing the appeal. On the ground of illness of Shri Sanjay Jain supported by medical record. Although the application is not strongly opposed by the learned counsel for the respondent, who says that if cost is imposed the delay in filing the appeal be allowed. The prayer is granted subject to the cost of Rs. 5000/- to be paid by the appellant to the counsel for the learned counsel for the respondent within four weeks from today.

The learned counsel for the appellant submits that both the appellants are brothers. It is stated by him that both the appellants have common defence in the matter and no contrary stand shall be taken by
