The contentions of the appellant is that after filing the appeal, notice u/s 8(4) was received by the appellant, therefore, the appellant is pressing for an interim order. After filing the appeal the possession was not taken by the respondent. The learned counsel for the respondent submits that interim order may not be passed as in view of the observations made by this Tribunal in the last order he has already informed to his officers not to take any further steps in view of notice u/s 8(4) issued by the respondent till the disposal of the appeal.
