With the consent of the parties we may clarify that the following order passed on 14th February, 2017 in FPA-PMLA-1136/SURAT/2015
be read in appeal No. FPA-PMLA-1139/SURAT/2015.
“The reply in the present appeal has been filed by the appellant against the order dated 22nd September, 2015. By the said order the Adjudicating Authority allowed the application filed by the respondent under Section 17(4) of PMLA Act, 2002 for retention of passport of the appellant alongwith filed document. The learned counsel for the appellant says that the appellant only intends to press the prayer in the present case directing the respondent to release the passport. He further submits that the appellant has already made the application before the authority, however, the passport has not yet been released. The counsel for the respondent has no objection if the respondent be directed to released to the passport to the appellant. Order is accordingly passed. The passport be released to the appellant within two weeks.
The counsel for the appellant wishes to withdraw the present appeal.
List on 1st March, 2017.
