Appeal was dismissed on 26^th May, 2015. Along with the application for restoration affidavit of Parokar which is father of Shri Mr. Amit Singh has been filed. It is stated in the application that he could not attend on 26^th May, 2015 as the appellant was in judicial custody. The counsel for the appellant states that he is still in custody. It is also a matter of fact that after filing the application for restoration, the applicant has filed the application for condonation of delay of 46 days in filing the restoration of appeal on the grounds given in Para No. 2 to 6 of the application. Replies to both the applications have been filed by the respondent-2. Since Shri Amit Singh is in custody and on the date of dismissal of the appeal he was also in custody, considering the overall FPA-ND-22/DLI/2014 Page 1 of 2
