As per the provision of Part XIV of Chapter VI of the Finance Act 2017, the Appellate Tribunal for Foreign Exchange (ATFE) has been merged with the Appellate Tribunal under the Smugglers & Foreign Exchange Manipulators (Forfeiture of Properties) Act 1976, w. e. f. 26.05.2017. The file in the above said matter has been received by this Tribunal on 1st July, 2017.
When the matter is taken up today, no one appears on behalf of the appellant. It appears form the order dated 1st August, 2016 that the Hon’ble Madras High Court had directed the appellant to deposit 15% of the penalty amount of Rs. 1 crors i.e. 15 lakhs within the period of 30 days from the date of communication of the order.
The learned counsel for the respondent submits that the said order
has not been complied by the appellant.

Since no one appears on behalf of the appellant, the registry will issue the notice to the appellant as well as his counsel for representing the case on the next date of hearing. In case the appellant has not complied with the order and does not appear on the next date of hearing, the appeal is likely to be dismissed.
