As per the provisions of Part XIV of Chapter VI of the Finance Act 2017, the Appellate Tribunal for Foreign Exchange (ATFE) has been merged with the Appellate Tribunal under the Smugglers & Foreign Exchange Manipulators (Forfeiture of Properties) Act 1976, w. e. f. 26.05.2017. The file in the above said matter has been received by this Tribunal on 1st July, 2017.
The statement has been made by the learned counsel for the respondent that the order dated 13th February, 2016 has not been complied for depositing pre-deposit amount of penalty. No one appears on behalf of the appellant and the appeal was dismissed by us before lunch session for non-compliance.

Later on the matter was mentioned by the learned counsel for the respondent who submitted before us that the said order has been complied with and the amount has been deposited by the appellant on 19th April, 2017 proof has been produced before us. The same are taken or record.
List the appeal on 21st December, 2017.
In view of the above, the earlier order passed in morning session vide which the appeal was dismissed is recalled. Since no one appears on behalf of the appellant the registry will issue the notice to the appellant and his counsel.
