As per the provisions of Part XIV of Chapter VI of the Finance Act 2017, the Appellate Tribunal for Foreign Exchange (ATFE) has been merged with the Appellate Tribunal under the Smugglers & Foreign Exchange Manipulators (Forfeiture of Properties) Act 1976, w. e. f. 26.05.2017. The file in the above said matter has been received by this Tribunal on 1st July, 2017.
The present appeal has been filed u/s 19 of the FEM Act, against the order dated 29 January, 2016. Alongwith the appeal, an application for waiving of pre-deposit amount has also been filed. We have gone through the appeal as well as the application for waiving of pre-deposit amount.

After small hearing, we are of the view that the appellant be exempted from depositing the penalty amount in view of averment made in the grounds of appeal material placed on record.
