As per the provisions of Part XIV of Chapter VI of the Finance Act 2017, the Appellate Tribunal for Foreign Exchange (ATFE) has been merged with the Appellate Tribunal under the Smugglers & Foreign Exchange Manipulators (Forfeiture of Properties) Act 1976, w. e. f. 26.05.2017.
The learned counsel for the appellant submits that in connected matters proceedings have been quashed by the Hon’ble High Court of Delhi in Criminal Appeal No. 450 of 2011 & Crl. M.A. 4157 of 2011 on 15th September, 2014. Copy of the order is placed before us. He submits that this appeal can also be disposed of on the same terms.
The counsel for the respondent submits that he is not ready with the matter as he has to reconstruct the file. The counsel for the appellant submits that the appellant is prepared to give the photo copies of the file,
