Valuation report has been filed by the respondent. It is taken on record. It is stated that the market rent of the said property is Rs.1 lakh 12 thousand. On the other hand Mr. Rajeev Awasthi, Advocate counsel for the appellant submits that the market rent of the said property is less than Rs. 70 thousands. It is a residential property and any part of the property is not used for commercial purpose. There are two versions given y the parties.
We are of the view that the appeal is expatiated. The order has already passed to deposit of sum of Rs. 70,000/-(Seventy thousand) per month as the rental charge for the said property may continue till the disposal of the appeal. The order is passed accordingly. The appellant shall

keep on depositing the said amount already fixed during the pendency of appeal.
List the appeal as well as pending application for final hearing on 20th April, 2017.
Both the parties may file the written submission on or before the
next date of hearing.
