Issue notice to the respondent. Let the reply be filed within six weeks and rejoinder within four weeks thereafter. The learned counsel for the appellant is pressing for interim order till the next date of hearing. He submits that in response of the possession notice dated 2nd September, 2016, the appellant had deposited a sum of Rs. 3.76 lakh with respondent by way of demand draft dated 9.9.2016 drawn in the name of Directorate of Enforcement, Bengaluru, as security deposit. According to him the value at present is Rs. 5.865 lakh. He submits that his client undertakes not to sell the said property or create any third party right/interest till the decision of the appeal. He also submits that the impugned property was purchased on 11th January, 1995 for the sum of Rs. 10,000; the said house was purchased by the appellant in terms of the sale deed on 21st February 2007 executed by one Smt. Nirmala with the office of the subRegistrar for total consideration of Rs. 3.76 lakhs and in order to show the bonafide of the appellant, the said amount has been deposited by the appellant. He also argued that the appeal be decided on merits and in case the appeal is decided against the appellant, the respondent has every right to take the possession of the property in accordance with the law. Considering the overall facts and circumstance of the case, the interim stay is granted till the next date of hearing as prayed in the application
