The appeal is already pending which is coming up on 9th December, 2016. There is prima facie case that the appellant is residing in the said property and the property is in the name of the appellant and his son (Shri Prakash Roy). The notice has been issued by the respondent on 04.10.2016 for taking the possession of the property. The learned counsel for the appellant submits that the appellant is a senior citizen and retired from the Indian Railways and he is residing in the said property. He has also filed the electricity bill, house tax and some related documents. The appellant undertakes not to dispose of /part with the property in any manner. In view of the undertaking given by the counsel for the appellant, possession of the

property is stayed till the next date of hearing. Notice dated 4th October, 2016 for taking possession of the property shall remain stay.
The learned counsel for the appellant is assured to argue the appeal on the next date of hearing. In view of the same no further adjournment will be granted.
