Three petitioners alleged that Respondent No.5 (Station House Officer, Butchireddypalem, SPSR Nellore District) was summoning and harassing them to hand over possession of land measuring Ac.0.60 cents in Sy.No.3 at Kavetipallam village, Butchireddypalem Mandal, and threatening them to settle a civil dispute pending in O.S. No. 393/2025 on the file of the Principal Junior Civil Judge Court, Kovuru, despite an injunction operating in their favour in I.A. No. 688/2025; relief was sought under Articles 14, 21 and 300-A of the Constitution and the doctrine of separation of powers. The learned Assistant Government Pleader (Sri P. Ajay Babu) stated on written instructions that, on petitioner No.2 approaching the Superintendent of Police, a preliminary enquiry was conducted under Section 175(3) of the Bharathiya Nagarika Suraksha Sanhita, 2023, the dispute was noticed to be civil in nature, and the police did not further call the petitioners. The Writ Petition has been filed for the following relief:

“… to issue a writ order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondents in summoning the petitioners to the police station and harassing the petitioners to handover the possession of the suit scheduled property which is pending on the file of the principle junior civil judge court kovuru through vide OS.No 393/2025 despite being an injunction order granted in favour of the petitioners is in force in lA.No 688/2025 of OS.No 393/2025 and continuously threatening the petitioners to settle the civil dispute which is pending on the file of the principle junior civil judge court kovuru vide OS.No 393/2025 as illegal arbitrary and violation of Article 14,21 and 300-A of the constitution of India and also contrary to the doctrine of separation of powers and consequently direct the respondents to not to interfere into the civil dispute which is pending on the file of the junior civil judge court kovuru through vide OS.No 393/2025 and not to threaten, summon or harass the petitioners with respect to the pending civil suit vide OS.No 393/2025 and pass…”

Heard learned counsel for the Petitioners and the learned Assistant Government Pleader.

Mr. Medikonda Pranay Venkat Chowdary, learned counsel for the Petitioners, submits that Respondent No.3 is interfering in the civil disputes pending between the Petitioners and Respondent Nos.6 to 8 in respect of land measuring Ac.0.60 cents in Sy.No.3, situated at Kavetipallam village, Butchireddypalem Mandal.

Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that petitioner No.2 had approached the Superintendent of Police, SPSR Nellore District, based on which, the respondent No.5 has called the petitioners to police station and conducted a preliminary enquiry as contemplated under section 175(3) of the Bharathiya Nagarika Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) and that in the Preliminary enquiry, it is noticed that the dispute in between the petitioners and respondent No.6 to 5 is civil in nature. Therefore, the police have not further called the petitioners to police station.

Considering the facts and circumstances of the case and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, directing the Respondent No.5 not to interfere henceforth in the civil dispute between the Petitioners and the Respondent Nos.6 to 8 without following due process of law.
