The Court made the following ORDER:

The writ petition is filed aggrieved by the impugned rejection letter dated 19.11.2025 issued by the 5^th respondent, whereby the application submitted by the petitioner on 03.11.2025 seeking compassionate appointment was rejected on the ground of limitation, in terms of Circular No. PD-29/2016 dated 17.06.2016. The said rejection is challenged as being illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

This Court, in exercise of its powers, has suo motu impleaded the District Collector, Kurnool, as the 6^th respondent to the present writ petition.

The case of the petitioner is that the petitioner is the daughter of late Shri Anga Prabhakar, who expired on 07.05.2017 due to health grounds. At the time of her father’s death, the petitioner was a minor. Upon attaining majority, she submitted an application dated 03.11.2025 seeking compassionate appointment. However, the same was rejected vide letter dated 21.11.2025 on the ground that the application was filed belatedly, i.e., beyond five years from the date of death of the employee. Aggrieved by the said rejection, the present writ petition has been filed.

The learned counsel for the petitioner submits that the said rejection is contrary to G.O.Ms.No.165 dated 20.03.1989, wherein the Government

issued specific instructions regarding consideration of cases of minor children for compassionate appointment. As per the said Government Order, in cases where the dependent is a minor at the time of death or medical invalidation of the employee, such dependent is entitled to apply for appointment immediately upon attaining the age of 18 years. In the present case, the petitioner was admittedly a minor at the time of her father’s death and had submitted her application promptly after attaining majority. Therefore, in view of the above Government Order, the petitioner is entitled to have her case considered for compassionate appointment.

Considering the submissions made and on perusal of G.O.Ms.No.165 dated 20.03.1989, this Court is of the opinion that the impugned communication dated 21.11.2025 is unsustainable and liable to be set aside. Accordingly, the writ petition is allowed by setting aside the impugned communication dated 21.11.2025, and the matter is remanded to the 6^th respondent, namely, the District Collector, Kurnool, who is the competent authority, to reconsider the application submitted by the petitioner on 03.11.2025 and to pass appropriate orders in accordance with the applicable rules and regulations. The said exercise shall be completed within a period of four (04) months from the date of receipt of a copy of this order. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the writ
