This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

“…..pleased to issue appropriate writ or direction more particularly one in the nature of writ of mandamus declaring the impugned action of the respondents Nos.3 to 6 in interfering with the land of the petitioners in Sy.No.224A for an extent of Ac.3.92 cents at Uddehal Village, Bommanahal Mandal, Ananthapuramu District, without issuing any notice and without following due procedure and trying to evict the petitioners from the schedule property is highly illegal and arbitrary and violation of Article 14, 21, 300-A of Constitution of India and consequentially direct the respondent Nos.3 to 6 not to interfere with the petitioners property in Sy.No.224A for an extent of Ac.3.92 cents at Uddehal Village, Bommanahal Mandal, Ananthapuramu District, without following due process of law and to pass…..”

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader appearing for Endowments.

Learned counsel for the petitioners submits that the petitioners are the owners and possessors of the property situated in Sy.No.224A, to an extent of Ac.3.92 cents at Uddehal Village, Bommanahal Mandal, Ananthapuramu

District, which was assigned by the 5^th respondent to the petitioners’ father by way of patta vide D.A. No.24/95, dated 22.10.1987, patta No.541. After the death of the petitioner’s father, the petitioners got succeeded the property and continued in possession. Later, based on a complaint, the land was erroneously treated as assignment land and included at the prohibitory list. However, upon verification, the 5^th respondent, vide proceedings dated 13.10.2020, confirmed that the land belongs to the petitioners by virtue of the patta. While so, the respondent Nos.3 to 6, without issuing any prior notice, trying to interfere with the petitioners’ peaceful possession is illegal, arbitrary and contrary to law. Hence, the Writ Petition.

Learned Assistant Government Pleader submits that the respondents

will follow due process of law as contemplated, if they intend to dispossess the petitioners from the subject property.

Having regard to the submissions of the learned counsel for the petitioners, the learned Assistant Government Pleader for the Endowments and on perusal of the material available on record, this Court is of the considered view that the present Writ Petition can be disposed of directing the respondents to follow due process of law, if they intend to dispossess the petitioners from the subject property.
