The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:-

“…to issue an appropriate Writ more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of the respondents more particularly respondent No. 4 in failing to provide police protection for the petitioner land situated in Survey Nos. 308, 316, 317/1, 317/2, 318, 319, and 315, totalling Ac. 21.13 cents in B. Tandrapadu Village, Kurnool Rural Mandal, even in spite of orders in I.A. No. 280/2024 in O.S. No. 785/2024 passed by the IV Addl. Junior Civil Judge, Kurnool, the Honble Court had directed Respondent No. 4 to provide police protection to implement the temporary injunction granted in I.A. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader.

Mr. Pathi Siva Prasad, learned counsel for the petitioner, submits that this Writ petition is filed questioning the action of the respondent police, the petitioner is aged about 78 years, he instituted suit in OS No.785 of 2024 on the file of learned IV Additional Civil Judge (Junior Division), Kurnool and obtained an Interim Injunction and later the learned Trial Court is also directed the police i.e., Station House Officer, Kurnool Taluka Police Station to provide police aid to petitioner in implementing the order of the

learned Trial Court passed in I.A.No.280 of 2024 in O.S.No.785 of 2024. Learned counsel for the petitioner further submits that the petitioner has submitted a representation dated 27.07.2024 through P.G.R.S under proper acknowledgment that the respondent No.4 has not taken any action. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that whenever, the petitioner approaches the Station House Officer, Kurnool Taluka Police Station, the police would give necessary police aid. The petitioner had submitted a complaint/ representation dated 27.07.2024 to respondent No.4 and it was acknowledged by the respondent No.4. There is a direction given by the learned IV Additional Civil Judge (Junior Division) Kurnool in I.A.No.280 of 2024 in O.S.No.785 of 2024 directing respondent No.4 to provide necessary police aid in implementing the orders passed by the learned IV Additional Civil Judge (Junior Division) Kurnool in I.A.No.280 of 2024 in O.S.No.785 of 2024.

When the Civil Court granted Interim Injunction in favour of the petitioner and directing the police to grant police aid, the respondent No.4 is duty bound to follow scrupulously the orders passed by the competent civil court.

Considering the entire facts and circumstances of the case, recording the submissions of the learned Assistant Government Pleader, the

respondent No.4 is directed to scrupulously follow the directions given by the learned IV Additional Civil Judge (Junior Division) Kurnool in I.A.No.280 of 2024 in O.S.No.785 of 2024 by providing necessary police aid to the petitioner for implementing the orders of the learned Civil Court. However, it is left open to the aggrieved party in the Civil Suit either to file appropriate petition for vacating the interim order or prefer appeal against the exparte injunction order, if so advised, before the competent civil court.
