The Court made the following ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief:

“to issue Writ or Order more in the nature of WRIT OF MANDAMUS declaring the impugned action of the respondents in not granting and releasing the payment of Additional Monetary Benefit, pertains to the left over service of 3 years and 3 months, in terms of Regulation 6(1)(b)(c) A.P.S.R.T.C. Employees (Service) Regulations, 1964 is illegal, arbitrary, discriminatory, and violation of Articles 14, 21 and 300(A) of the Constitution of India and consequently direct the respondents to forthwith release the above amounts together with interests on delayed payments to the petitioner and pass….”

Heard the learned counsel for the petitioner and the learned Government Pleader for the respondents.

The case of the petitioner is that he was appointed as a Conductor and joined service at Sattenapalle Depot on 13.02.1988. Subsequently, he was transferred to various depots and finally posted at Chilakaluripeta Depot on 19.02.1992. Due to health problems, he opted for voluntary retirement and was relieved from service on 30.03.2022. By that time, he had completed 32 years and 8 months of service in the respondent Corporation and still had 3 years and 3 months of service left before reaching the normal age of superannuation. His service conditions are governed by the A.P.S.R.T.C. Employees (Service) Regulations, 1964. It is submitted that he fulfilled the eligibility criteria for voluntary retirement under Regulation 6(1)(b)(c) of the said Regulations and accordingly retired from service. However, after his retirement, the respondent Corporation did

not pay the additional monetary benefits for the left-over service period, to which he claims to be entitled under the said Regulations. Therefore, the non-payment of the said benefits by the respondents is illegal and arbitrary. Hence the present writ petition.

On the other hand, the learned Standing Counsel appearing on behalf of the respondents submits that the petitioner has made a representation only in the month of June, and the respondent authorities will consider the same and pass appropriate orders on the petitioner’s request within a short period.

Considering the said submissions and upon perusal of the material available on record, without going into the merits of the case, the writ petition is disposed of at the admission stage directing the 3^rd respondent to consider the representation of the petitioner. If the petitioner is found entitled to the additional monetary benefits, the same shall be considered and released within a period of three months from the date of receipt of a copy of this order. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in the writ petition shall stand closed.
