This writ petition is filed under Article 226 of the Constitution of India, claiming the following relief:

“To issue Writ of Mandamus declaring that the petitioners 1 to 33 are entitled to undergo the Theory classes in Anesthesia at Government Medical College Vijayanagaram for a period of One year in Anaesthesia as per the proceedings in C No 2789333/CT/ME/2025 Dt 23.01.2026 and consequently direct the Principal Government Medical College Vijayanagaram / 2^ND Respondent herein to issue circular to the Department of Anaesthesia to conduct the Theory classes to the petitioners 1 to 33 in their Anaesthesia course in the Department of Anaesthesia at Government Medical College Vijayanagaram for a period of One year from the date of reporting”

The brief facts of the case are that, the petitioners herein have completed the Intermediate course and are presently pursuing Diploma in Anaesthesia in Respondent No.3 College. As part of the said diploma courses, theory classes for a period of one year are required to be conducted at the Government Medical College, Vizianagaram. The petitioners have paid the requisite fee towards the theory class training. Vide proceedings in C.No. 2789333/CT/ME/2025 Dated 23.01.2026, the Directorate of Medical Education, Vijayawada, has

accorded permission to the petitioners to undergo the said training. However, when the petitioners reported before Respondent No.2 for attending theory classes in Anaesthesia, they were not permitted to attend the classes. Aggrieved by the said action of Respondent No.2, the petitioners have approached this Court by filing the present writ petition.

During hearing, Sri T. Lakshmi Narayana, learned counsel appearing for the petitioners submits that the petitioners are duly admitted into the Diploma in Anaesthesia course and have also paid the requisite fee for undergoing the theory class training. It is further contended that the Directorate of Medical Education, Vijayawada, has already granted permission to the petitioners to undergo the clinical training programme and the associated academic training. In spite of such permission, Respondent No.2 is not permitting the petitioners to attend the theory classes, which are an integral part of the one-year diploma programme. The learned counsel submits that such action of Respondent No.2 is arbitrary and seeks direction from this Court permitting the petitioners to undergo the theory classes.

On the other hand, learned Government Pleader for Medical and

Health, appearing for Respondent No.2, submits that the issue involved pertains to conduct of training programmes under the control of the Directorate of Medical Education and requested this Court to pass appropriate orders in the matter.

Heard Sri T. Lakshmi Narayana, learned counsel for the petitioner, learned Government Pleader for Medical & Health and perused the material available on record.

This Court observes that, once permission has been accorded by the Directorate of Medical Education, Vijayawada vide proceedings in C.No. 2789333/CT/ME/2025 Dated 23.01.2026 permitting the petitioners to undergo the clinical training at Government General Hospital, Vizianagaram and theory class at Government Medical College, Vizianagaram, the theory classes also form part and parcel of the one-year diploma programme. Therefore, a duty is cast upon Respondent No.2 to impart the required theory classes to the petitioners and Respondent No.2 cannot evade such responsibility. Respondent No.2 is under binding duty to conduct and facilitate the theory classes to the petitioners.

Accordingly, Respondent No.2/Principal, Government Medical College, Vizianagaram, is directed to permit the petitioners to undergo one-year Theory classes in Anaesthesia, within a period of two (02) weeks from the date of receipt of a copy of this order.
