The Counter of Respondent Nos. 6 and 7 stated that all plots in Patha Adavivaram Layout stood allotted with none presently available, though efforts were being made to procure new plots from developers. Observing that Chapter 8 of the Andhra Pradesh Cooperative Societies Act, 1964 provides for settlement of disputes, the Court held it appropriate for the Petitioner to raise a dispute under that Act rather than press for disposal of his representations, and accordingly disposed of the Writ Petition leaving that avenue open, with no order as to costs and pending miscellaneous petitions closed. The Writ Petition is filed questioning the action of the respondent Nos. 5 to 7 in not considering the representations of the Petitioner dated 28.10.2024 and 06.10.2020 as illegal and arbitrary.

The facts leading to the filing of the writ petition are as follows:

The Petitioner has been a Member of Respondent No. 6 Society since 1991 and had been permitted to pay an amount of Rs. 2,000/towards the initial site value for allotment of house plots in the layout of Respondent No. 6.

The grievance of the Petitioner is that though the Petitioner was admitted as a Member, no plot was allotted to the Petitioner, and the representations espousing the grievance of the Petitioner were not considered.

In the Counter Affidavit filed by the Respondent Nos. 6 and 7, it is stated that all the plots of Patha Adavivaram Layout were allotted to the members and that there are no available plots at present. It is further stated that the Managing Committee of the Respondent No. 6 is making efforts to take new plots from developers, and in the event of land being available to the Respondent No. 6, the Respondent

Authorities would allot a plot to the Petitioner as per the Bye-Laws of the Society.

Learned counsel for the Petitioner submits that there are plots available at present with the Respondent No. 6 and that they are deliberately not allotting the plots to the Petitioner.

Heard the learned counsels.

The Andhra Pradesh Cooperative Societies Act, 1964, provides for settlement of disputes in Chapter 8 of the said Act. It would be appropriate for the petitioner to raise a dispute under the provisions of the said Act rather than seeking disposal of the representations.

In view of the above, the Writ Petition is disposed of, leaving it open to the Petitioner to raise a dispute in terms of the Andhra Pradesh Cooperative Societies Act, 1964, for resolution of his grievance. No order as to costs.

As a sequel, the miscellaneous petitions, if any, pending in this Petition shall stand closed
