Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue a Writ or order or direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 3rd respondent in awarding works of carrying out operation and maintenance including watch and ward of 33/11 KV Sub Stations in the operation circle of Kurnool District infavour of the respondents No.8 to 48 violating the conditions of Tender Notice No.02/2014-15 in proceedings No.SE/0/ KNL/T.SBE.I/F/D.No.902/14 dated: 11.07.2014 as bad arbitrary, illegal and unconstitutional and consequently set aside the said tender Notice dated: 11.07.2014 and pass such other and further order or orders, as this Honble court may deem fit and proper in the circumstances of the case in the interest of justice.

None appeared for the petitioners. Heard the learned counsel for the respondents.

The present Writ Petition is filed declaring the action of the respondent No.3 in awarding the works for carrying out operation and maintenance including watch and ward of 33/11 KV Sub-Stations in the operation circle of Kurnool District in favour of the respondent Nos.8 to 48 violating the conditions of the tender notice dated 11.07.2014 as illegal and arbitrary.

When the matter is taken up for hearing, learned counsel for the respondents submits that the proposed contract is only for a period of four months i.e., from 01.12.2014 to 31.03.2015 and the said contractual period was already elapsed long back. Hence, cause in the present Writ Petition does not survive for further adjudication and the matter becomes infructuous.

Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
