COMMON ORDER:

These Writ Petitions are filed questioning the „Endorsement, dated 27.09.2015‟ of the Respondent No. 3 in rejecting the Community Certificate of the Petitioner as „Madasi Kuruva‟ as illegal and arbitrary and set aside the Endorsement as contrary to the provisions of A.P. (SC, ST, and BCs) Regulation of Issue of Community Certificates Act, 1993 (for short, „the Act, 1993‟).

The Petitioners had applied for Community Certificate as „Madasi Kuruva‟ under the provisions of the said Act. The said applications were rejected with an endorsement dated 27.09.2015, “Not Recommended by the Tahsildar,” and no other reason is forthcoming for rejection of the cases of the Petitioners.

The composite High Court of Andhra Pradesh and Telangana at Hyderabad in W.P.No.36644 of 2015 had considered a similar issue of rejection of claim for Community Certificate of „Madasi Kuruva‟ and set aside the similar endorsement and remanded the issue to the concerned authority to pass a reasoned order.

The operative portion of the order in W.P. No. 36644 of 2015 is as follows:

“ Accordingly, the Writ Petition is allowed; the impugned endorsement dated 04.09.2015 is set aside and the matter is remitted back to the Respondent No.3; the Respondent No.3 shall furnish to the Petitioner copy of the Report of the Mandal Revenue Inspector as well as the recommendation of the Tahsildar within two (02) weeks from the date of receipt of a copy of this Order; the Petitioner shall then file his objections to the same within four (04) weeks from the date of receipt of above documents; and thereafter, the Respondent No.3 shall pass a reasoned order and communicate the same to the Petitioner. No costs”.

In the light of the above, the Writ Petitions are disposed of in terms of the Orders in W.P.No.36644 of 2015, dated 12.09.2016. The Respondent Authorities are directed to re-examine the cases of the Petitioners in terms of the above directions.
