Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to to issue an appropriate Writ order or direction one in the nature of Writ of Mandamus declaring the action of the 1st respondent Order vide Case No.23340/SIC/PVB/2015, dated 21.08.2015 issued by the 1st respondent i.e. State Information Commissioner, State of Andhra Pradesh depriving Fundamental and Legal Rights of the 1st petitioner as illegal, arbitrary, discrimionatory, and unconstitutional at the same time violative of Articles 14, 19 and 21 of the Constitution of India besides contrary to the law laid down by the Hon'ble Supreme Court in India in Union of India Vs Namit Sharma, 2013 (10) SCC 359 and Union Public Service Commission (UPSC) Vs. R.K.Jain and Catena of Cases and to set aside the same, along with all the proceedings issued incidential thereto and in connection therewith the impugned order to set aside the same and to pass

This Writ Petition came to be filed under Article 226 of the

Constitution of India, seeking the following prayer:

“…to issue an appropriate Writ order or direction one in the nature of Writ of Mandamus declaring the action of the 1st respondent Order vide Case No.23340/SIC/PVB/2015, dated 21.08.2015 issued by the 1st respondent i.e. State Information Commissioner, State of Andhra Pradesh depriving Fundamental and Legal Rights of the 1st petitioner as illegal, arbitrary, discrimionatory, and unconstitutional at the same time violative of Articles 14, 19 and 21 of the Constitution of India besides contrary to the law laid down by the Hon'ble Supreme Court in India in Union of India Vs Namit Sharma, 2013 (10) SCC 359 and Union Public Service Commission (UPSC) Vs. Brief facts of the case are that the 2^nd petitioner (wife of the 1^st

petitioner) filed a complaint on 22.07.2015 before the 1^st respondent, alleging that the information sought by her was not furnished by the office of the 2^nd respondent. The information sought by the 2^nd petitioner is relating to a third party employee (4^th respondent herein) under the Right to Information Act, which had already been supplied in part. The 1^st respondent observed that supply of such information is against the law laid down by the Hon'ble Apex Court in Chief Information

Commissioner and another Vs. State of Manipur and another¹ ; furthermore, the 1^st respondent advised the concerned authorities to transfer the 1^st petitioner, who was working as Principal of G.V.R. Government College, Vijayawada to some other district. Aggrieved by the same, the present writ petition is filed.

When the writ petition came up for hearing on 18.11.2015, this Court passed the following interim order:

“…Hence, the directions contained in the last paragraph of the impugned order shall remain stayed.”

Perused the entire material available on record. Today when the writ petition came up for hearing, learned Standing Counsel for respondents furnished a copy of instructions of the 2^nd respondent wherein it is stated that pursuant to the interim orders passed by this Court, the directions of the 1^st respondent in the impugned proceedings were not implemented; it is further stated that pending the present petition, the 1^st petitioner got retired on 30.11.2024 as Principal of Dr. MBK Government School of Music and Dance, Guntur, upon attaining the age of superannuation.
