The Writ Petition has been filed under Article 226 of the Constitution of India seeking the following relief:-

<…Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction on the part of respondents on petitioners representation dated 15.11.2025, submitted for initiating proceedings under Section 126 of Chapter IX of Bharatiya Nagarik Suraksha Sanhita, 2023 against the respondent 9 and her followers for their repeated illegal acts and high-handed interference, demolishing fencing and access road to the Temple premises, throwing slippers and pelting stones at pilgrims and Trust members, creating nuisance, obstructing devotees, and threatening with dire consequences, thereby causing breach of peace and disturbance to public tranquility as illegal, irregular, irrational and amounts to non-discharge of legal obligation conferred on respondents 1 to 8 under the provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023 and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents 2 to 5, particularly respondents 5, 7 and 8 to initiate proceedings under Section

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader.

Sri M.S.S. Swayam Prakash Babu, learned counsel for the petitioner, submits that the representation dated 15.11.2025 submitted by the petitioner was not considered by the respondent/police.

Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that a similar representation of the petitioner was considered by the police. Accordingly, a case in Crime No. 86 of 2025 was registered for the alleged offences punishable under Sections 329(3), 324(4), 351(2) read with 3(5) of 8the BNS9, and another case in Crime No. 91 of 2025 was registered for the alleged offences punishable under Sections 329(3), 324(5), 351(2) read with 3(5) of 8the BNS9 by G.D. Nellore Urban Police Station. It is further submitted that the FIRs indicate the existence of a private land dispute between the petitioner9s trust and the villagers.

The learned Assistant Government Pleader further submits that the representation dated 15.11.2025 was not received by the respondent/police.

Pleader, the writ petition is disposed of by granting liberty to the petitioner to submit a fresh representation to the respondent/police within a period of two (2) weeks from the date of receipt of a copy of this order. Upon such submission, the police shall consider the same in accordance with law. If any law and order issue is perceived by the Investigating Officer, he shall report the same to the Executive Magistrate/Mandal Executive Magistrate for initiation of appropriate proceedings in accordance with the provisions of 8the BNSS9.
