The present Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:

“to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus or an appropriate writ or order declaring the action of the respondents in not extending the benefit of enhancement of the age of superannuation up to 62 years to the petitioner herein also, on par with the regular Govt. employees, by extending the benefit of G.O.Ms.No.15, dated Finance Department dated 31-1-2022 and discharging from service at the age of 60 years, as illegally, arbitrary and unconstitutional and consequential the Hon’ble High Court may pleased to declare that the petitioner herein is also entitled to continue in service as Data Entry Operator (Minimum Time Scale plus DA), till attaining the age of 62 years, with all consequential benefits and may pass such….”

Heard Mr.M.R.Tagore, learned counsel for the petitioner and learned Government Pleader appearing for respondents.

The contention of the petitioner is that while pending the present writ petition, the respondent authorities have considered and regularized the services of the petitioner vide G.O.Rt.No.153 dated 31.01.2026. In view of the said circumstances, the petitioner is entitled to continue till he attains the age of 62 years.

Considering the submissions and on perusal of the orders of the Government, the Writ Petition is disposed of directing the respondents to extend the benefit of G.O.Ms.No.15 dated 31.01.2022 to the petitioner as the services of the petitioner was already been regularized vide G.O.Rt.No.153 dated 31.01.2026. No costs.
