The Court made the following order:

Learned counsel appearing for the petitioners submits that the petitioners are retired employees of BHPV Limited, Visakhapatnam. It is submitted that the petitioners are members of the 3^rd respondent-Housing Society and are aggrieved by the inaction on part of the 3^rd respondent in allotting the plots to its members.

It is submitted that Bye-law 43 of the 3^rd respondent-Society would mandate allotment of plots to its members and that the procedure to be followed is detailed under Regulation.43. It is submitted that, though the 3^rd respondent has not allotted individual plots to the petitioners, it has called upon them to pay the amount required for construction in five equated installments.

It is submitted that the petitioners, being retired from service, cannot comply with the demand of the 3^rd respondent unless the 3^rd respondent specifically earmarks the plots in their favour individually. It is further submitted that, upon allotment and registration of the plots in favour of the petitioners, they would be in a position to apply for loans and comply with the notice calling upon the petitioners to make the requisite payments.

The Writ Petition was filed apprehending coercive action against the petitioners in pursuance of a notice dated 28.11.2025 for a General Body Meeting of the members of the Society. The meeting was scheduled to be on 21.12.2025. It is submitted that this Court considering the grievance of the

petitioners, granted interim orders on 20.12.2025 directing the respondents not to take any coercive steps to remove the petitioners from the list of beneficiaries/members, which would have enabled the respondents to allot the plots as per their whims and fancies.

The learned counsel appearing for respondent No. 3 submits that a detailed counter-affidavit is filed and that it is submitted that there are 352 beneficiaries in the Society and that an equal number of plots are available for the members. It is further submitted that the 3^rd respondent has obtained permission for developing a group housing project and, except the petitioners, none of the other beneficiaries have raised any concern.

It is submitted that the Society has spent substantial amounts towards development and has also paid the requisite fee for obtaining permission from the competent authorities. It is further submitted that the 3^rd respondent has no option but to take further steps against any beneficiary, who is not inclined to pay the construction cost.

It is submitted that, in the General Body Meeting held on 21.12.2025, it was resolved to grant one more opportunity to those beneficiaries who have not paid the construction cost, by permitting them to pay the outstanding amount together with interest at the rate of 12%. The said resolution was passed by a majority of the members. The time for payment was also extended up to 31.01.2026.

The learned counsel for respondent No.3 further submits that the petitioners have raised a comprehensive dispute before the District Registrar of Cooperative Societies, Visakhapatnam, and the same is pending adjudication. The issues raised by the petitioners before this Court are required to be considered by the District Registrar in the A.R.C.No.1 of 2025, pending on the file of the 2^nd respondent.

Considering the submissions, the Writ Petition is disposed of leaving it open to the petitioners to raise all contentions urged before this Court before the 2^nd respondent. The 2^nd respondent shall consider and decide A.R.C.No.1 of 2025 on its own merits.

Pending disposal of A.R.C.No.1 of 2025, the interim order granted by this Court shall sustain. The 2^nd respondent shall decide A.R.C.No.1 of 2025 on its own merits, uninfluenced by the interim order passed by this Court.

¶69

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

¶70

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
