The petitioner herein is an accused in C.C.No.4 of 2016, pending before the Judicial First Class Magistrate, Podili, for offences punishable under Sections 143, 188 and 283 read with Section 149 of Indian Penal Code, 1860. The petitioner had approached this Court, by way of Crl.P.No.3323 of 2016, for quashing the said complaint.

During the pendency of this complaint, the learned Public Prosecutor, in the High Court of Andhra Pradesh had referred this case to the Lok Adalat, in the High Court, on the ground that C.C.No.4 of 2016 had ended in acquittal of the accused, after a full trial. The Lok Adalat, recorded the said contention and passed an Award, dated 13.08.2022, dismissing the Criminal Petition as infructuous.

The petitioner being aggrieved by this Award, has approached this Court, by way of the present writ petition. The contention of the petitioner is that there was a stay of further proceedings in C.C.No.4 of 2016 and as such, no trial had taken place in the matter. The petitioner would further contend that the petitioner has not been acquitted in the said case and the learned Assistant Public Prosecutor, under a mistaken impression that the complaint had been dismissed, had referred the matter to the Lok Adalat.

Ms.Shaik Shahedaz, learned counsel appearing for the de facto complainant admits that there was no acquittal of the petitioner in C.C.No.4 of 2016 and that no trial had taken place in C.C.No.4 of 2016.

In that view of the matter, this is an appropriate case for setting aside the Award passed by the Lok Adalat as there would be failure of justice if the said criminal petition is dismissed as infructuous.

Accordingly, this Writ Petition is allowed, setting aside the Award of the Lok Adalat in the High Court, dated 13.08.2022 and restoring the Criminal Petition No.3323 of 2016, along with interlocutory orders, if any, to file. There shall be no order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
