The Court made the following ORAL ORDER:

Heard Sri S. Srinivasa Rao, Ld. Counsel for the Writ Petitioner and Sri T. Sanjeeva Rao, Ld. Asst. Government Pleader for Revenue and Sri V.V. Satish, Ld. Standing Counsel for the APEPDCL.

In compliance with the Order of this Court dated 02.12.2025, the Revenue Officials i.e., the Mandal Surveyor, Tekkali Mandal of Srikakulam District has conducted a Survey in the presence of the Writ Petitioner and the other stakeholders on 04.12.2025. To this effect, a Survey Report dated –Nilhas been prepared by the Mandal Surveyor, Tekkali Mandal of Srikakulam District. Along with this Report, copies of the Revenue Record has been placed on record by way of a Memo dated 12.12.2025.

On perusal of the Report submitted by the Mandal Surveyor, Tekkali Mandal of Srikakulam District, it transpires that the Writ Petitioner’s rice mill is situated in Zeroyathi land in Survey No.80-15 and the transformer, which supplies the electricity to the rice mill of the Writ Petitioner has been located in Survey No.93/1 which belongs to the Gramakantam.

It is the contention of the Respondents that this transformer is now required to be relocated in the Zeroyathi land belonging to the Writ Petitioner inasmuch as the said Gramakantam land in which the present transformer is presently located is obstructing the road expansion programme undertaken by the Grama Panchayat. After conducting the Survey in the presence of the Writ Petitioner and other stakeholders the Mandal Surveyor has prepared a Report and had submitted it to the Tahsildar, Tekkali along with the Photographs which are filed along with Memo. This Report and the Photographs would indicate that the representatives of the Writ Petitioner were also present.

Since the present space where the transformer is located is required to be utilized by the Panchayat for expansion of road and since the said land is a Gramakantam land, this Court is of the opinion that the

transformer shall be relocated in the space belonging to the Writ Petitioner in Survey No.80-15 (premises of the Rice Mill itself).

The relocation of the Transformer shall be done within a period of two (02) weeks from the date of uploading of this Order on the web-site of this Court. The Official Respondents, particularly, the Respondent Nos. 4 to 6 are directed to make a make-shift arrangement during the shifting process to ensure that the power supply is given to the Writ Petitioner’s rice mill seamlessly. Thereafter, the Official Respondent Nos. 4 to 6 shall erect proper transformer as per the Rules in the space belonging to the Writ Petitioner in Survey No.80-15.

With these observations and directions, this Writ Petition disposed of. No order as to costs.

Interlocutory Applications, if any, stand closed in terms of this order.
